Johnson & Johnson Loses Another Talc Powder Lawsuit

In a consolidated New Jersey trial, a judge and jury unanimously found that Johnson & Johnson exposed all four plaintiffs to asbestos, without warning consumers about the dangers of its talc powder products. As a direct result of J&J’s defective design and manufacturing, four people developed mesothelioma.

Unquestionably Liable

The case against J&J was so strong that the judge threw out the defense’s closing statement and the jury awarded a $37.3 million verdict. These damages are only compensatory, awarded directly to the four plaintiffs, but punitive damages are soon to follow. During the trial, J&J was referred to as:

“liars, predators, manipulators, poisoners, ludicrous, baby-killers, and much, much more”

The case’s fact-finders did not disagree.

Not the First Time

While one of the most transparent, this lawsuit is not the only one that has successfully held J&J liable for causing mesothelioma. Last year, the company was hit with $80 million in punitive damages after their talc powder caused mesothelioma in a New Jersey man. In Northern California and Alameda County, plaintiffs were awarded verdicts of $29 million and $12 million, respectively.

J&J has also been found responsible for several cases of ovarian cancer caused by their talc products.

Refusing to Take Responsibility

Despite their most recent loss, J&J insists their talc-based products are safe. In fact, the company filed a motion for mistrial immediately after receiving the latest verdict. Still, reports that J&J knew about their products’ asbestos problems are popping up left and right. According to a report from Reuters, the company has found small amounts of asbestos in their products since at least 1971.

They continue to claim that their products are safe.

Fighting Back

Despite Johnson & Johnson’s claims, the company’s most loyal customers continue to develop ovarian cancer and mesothelioma. As a result, J&J faces over 14,000 lawsuits.
